a health care provider that conducts certain transactions in electronic form (called here a “covered health care provider”),
- a health care clearinghouse, or
- a health plan
It doesn’t look like you work for any of those three. It is, of course, an intrusion into your privacy, but does not seem to be a HIPPA violation.
First off, just for the record, it is HIPAA (Health Insurance Portability and Accountability Act). No, there does not appear to be a violation of HIPAA here, due to the fact that the people that posted the note are not in any way health care providers. Therefore, the only way that anyone there had access to the details of your condition is because you willingly told them. This does not constitute a HIPAA violation. It is extremely rude and inappropriate for them to divulge your information that I’m sure you told them in confidence, however it isn’t a violation of your rights. In the future I would just be careful with whom you share private information.
